Open Letter From Kanaka Maoli Kupuna to Obama

Dear President-elect Barak Obama:

We, the undersigned Kanaka Maoli (Hawaiian) kupuna (elder
spokespersons), write this Open Letter to you on behalf of many in
our Kanaka Maoli nation who are indigenous to these islands in which
you were born, to welcome you home, with your Chicago ‘ohana
(family), for a well-deserved nanea (rest and relaxation).

We join with millions the world over to ho‘omaika‘i (congratulate)
you on your election and upcoming inauguration as the 44th president
of the United States of America, and to applaud your inspiring
message of Hope and Change for a world in desperate need of a lasting
peace that, we all know, can only blossom with pono (justice).

As you share this season of renewal here with us on O‘ahu, we feel
compelled to direct your attention to the plight inflicted by the
U.S. on our Kanaka Maoli people and lands since 1893 when the U.S.
first invaded our islands. This century-long plight has caused our
people to now suffer the highest rates of homelessness, poverty,
school drop-out, prison incarceration, heart disease, cancer, stroke,
diabetes, hypertension, smoking, alcoholism and drug addiction. Our
people now demand redress, which we respectfully herewith summarize:

1. Our Kanaka movement for redress, smoldering since 1893, erupted in
January 1993 on the occasion of the centennial anniversary of the
U.S. armed control of our homeland, and now grows stronger every day.
This 1893 landing, carried out in shameful complicity with local
haole (white) businessmen, effected the overthrow of our revered

Protest against stolen lands

http://kauaiworld.com/articles/2008/12/27/news/kauai_news/doc4955de9d595...
Protest a ‘solidarity action’ with O‘ahu rally
By Michael Levine - The Garden Island
Published: Saturday, December 27, 2008 1:10 AM HST
A group of 25 to 30 activists lined both sides of Kuhio Highway in Lihu‘e yesterday afternoon, waving Hawaiian flags and holding signs voicing their displeasure with Gov. Linda Lingle’s handling of the controversial ceded lands issue.

The demonstration, organized by the Kaua‘i Alliance for Peace and Social Justice, was described by those involved as a “solidarity action” with a similar protest taking place in front of the state Capitol on O‘ahu. That rally drew about 100 people, according to an Associated Press report.

At issue is the Lingle administration’s continued appeal to the U.S. Supreme Court to overturn a Hawai‘i Supreme Court ruling handed down in January that prohibited the state from selling or transferring more than a million acres of public lands that had belonged to the Hawaiian monarchy prior to the 1893 overthrow.

In 1993, President Clinton signed the Hawai‘i Apology Resolution, acknowledging American wrongdoing in the overthrow. The Office of Hawaiian Affairs used that resolution as the basis for a lawsuit filed against the state in the mid-1990s seeking an injunction to prevent the selling or transfer of the ceded lands.

That effort was largely fruitless until the Hawai‘i Supreme Court ruling overturned an earlier Circuit Court decision early this year.

Native Hawaiians protest ceded lands case

Updated at 2:06 p.m., Friday, December 26, 2008
http://www.honoluluadvertiser.com/article/20081226/BREAKING01/81226026
Native Hawaiians protest ceded lands case

Advertiser Staff

About 100 people from various Native Hawaiian groups rallied in front of the state Capitol today to demonstrate their objection to Gov. Linda Lingle's position on ceded lands, those lands that belonged to the Hawaiian government and were taken over at the 1898 overthrow.

A Hawai'i Supreme Court decision last January bars the state from selling or transferring ceded lands until claims by Native Hawaiians to those lands are resolved.

State Attorney General Mark Bennett appealed that decision to the U.S. Supreme Court, which has agreed to hear the case in mid-February.

The state's position is that, like other states, the U.S. granted Hawai'i the full authority to buy or sell lands put under its jurisdiction by the federal government.

Rally to protect ceded lands

Start: Dec 26 2008 - 3:00pm

SOLIDARITY ACTION

PROTECT THE “CEDED” LANDS

Join Kaua'i Alliance for Peace and Social Justice in a solidarity demonstration with the big rally being held at the same time in Honolulu!

When:
FRIDAY DECEMBER 26, 2008
3-5 PM

Where:
Intersection of Kuhio Hwy and Hardy St., Lihue (across from Mc Donalds)

Why:
Governor Lingle is pressing the US Supreme Court to overturn the moratorium on the sale of “ceded” lands.

She hopes the US Supreme Court will clear the way for the State to start selling off the “ceded” lands – to big business and development interests.

It is WRONG for the state to attempt to clear the way for a fire-sale of Native lands without proper resolution of the many injustices facing the Native Hawaiian people.

Tell Lingle and the State of Hawai'i to withdraw the appeal and honor the moratorium on land sales until Native Hawaiians - through THEIR OWN PROCESS OF SELF-DETERMINATION – can deal properly with the question of the “ceded” lands.

Bring signs!

· WITHDRAW SUPREME COURT APPEAL!
· PROTECT NATIVE LANDS!
· UPHOLD THE MORATORIUM!
· NO SALE!
· SELF-DETERMINATION FOR KANAKA MAOLI!
· KEEP HAWAIIAN LANDS IN HAWAIIAN HANDS!
· CEDED LANDS BELONG TO THE HAWAIIAN PEOPLE!
The Final Coup

The Final Coup
by Joan Conrow / 02-27-2008
The Final Coup
http://honoluluweekly.com/cover/2008/02/the-final-coup/

A proposed ceded lands payback agreement signed Jan. 17 between the state and Office of Hawaiian Affairs (OHA) has triggered an impassioned public debate over what lands actually belong to Native Hawaiians and what form their self-government may take.

At the crux of the matter is the rightful ownership of some 1.8 million acres of the Hawaiian Kingdom public lands– comprising an estimated 40 percent of Hawai’i’s total land mass and 95 percent of all acreage under state control — and who should determine how they are used. The agreement, originally called a settlement and now incorporated into House Bill 266, would give OHA $200 million in land and cash as back-due payment from ceded lands income and a to-be-determined share of future revenues.

The state/OHA deal was followed two weeks later by a Hawai’i Supreme Court ruling that bars the state from selling any of the ‘ceded lands’ until the question of their ownership is resolved.

Whether the Hawaiian nation and its territory will be determined through international law, independence or the Akaka Bill, which would establish a nation-within-a-nation under federal jurisdiction on the Native Americans model, is a hot topic. The Akaka Bill has been endorsed by Gov. Linda Lingle, Attorney General Mark Bennett, presidential hopefuls Sen. Barack Obama and Sen. Hillary Clinton, and OHA, itself a state agency.

On behalf of the Aha Kiole Advisory Committee, Kauai Kiole Sharon Pomroy, Niihau Kiole Ilei Beniamina, and Kona Hema Moku Representative Billy Kaohelaulii, we invite you to attend a public community Aha Moku Advisory Concil meeting on Tueday, December 16, 2008 at the Kekaha Neighborhood Center. The meeting will be from 5:00 p.m. to 8:00 p.m.

The purpose of the meeting is to give the people of Kauai and Niihau, the Hawaiian organizations and the general public a status report on the Aha Moku system for Kauai and Niihau; to get acceptance for this grassroots community consultation process; to identify moku issues and concerns; and to finalize the process on the moku structure. The results of this meeting will be part of the Final Legislative Report on the Aha Moku Systems that will be submitted to the Hawaii State Legislature in December 2008.

Please let as many people as possible know about this meeting. All of Kauai’s legislators, County Council, Planning Depts., and Hawaiian organizations have received notices of this meeting so we have to have our Hawaiians and locals there too.

Act 212 – the Aha Moku System
